Nevada Client Assistance Program
Please Note:
Governor Sandoval has redesignated the Client Assistance Program (CAP)
in the State of Nevada to The Nevada Disability Advocacy and Law Center
(NDALC). The redesignation of Nevada’s CAP to NDALC takes effect
November 9, 2012, and any currently open cases will continue to be
handled by NDALC as the new CAP agency with the utmost professionalism
and consideration for Nevada’s CAP clients.
A Public Hearing on this matter, held on September
24, 2012 with statewide meeting locations available, provided members of
the public an opportunity to provide comment with regard to this
decision. Public posting of the redesignation process, the public
hearing, and a public comment period of more than 30 days, was executed
in accordance with Nevada open meeting law. Having fully considered the
feedback received, Governor Sandoval is convinced that the decision to
redesignate is both appropriate and in the best interest of our State.
The Nevada Disability Advocacy and Law Center (NDALC)
has been providing legal and non-legal advocacy to individuals with
disabilities statewide since 1995. As a private non-profit protection
and advocacy organization, NDALC can operate the CAP in a truly
independent and autonomous manner in conformance with the spirit and the
letter of federal law. Located in more communities, NDALC has greater
ability to serve Vocational Rehabilitation (VR) and Independent Living
(IL) participants and applicants, and to integrate the mission of the
CAP into its outreach and education programs statewide. NDALC will
administer the CAP to achieve fair and impartial dispute resolution
between participants and applicants, program staff and service
providers. With the selection of NDALC as the redesignated CAP agency,
Nevada will join a majority of states which have the CAP located outside
of the agencies providing client services. NDALC will continue to work
closely with DETR’s Rehabilitation Division to ensure that VR and IL
participants and applicants are aware of their rights to utilize CAP and
receive accurate contact information.

excellent service to Nevadans with disabilities.

Client Assistance Program
The Client Assistance Program (CAP) is designed
to assist individuals with disabilities resolve problems they may
experience with any of Nevada's rehabilitation programs.
CAP representatives are also responsible for informing individuals with
disabilities of the rehabilitation programs, services and benefits
available in Nevada. This goal also includes reaching residents who have
traditionally been underserved by rehabilitation programs.
CAP services include:
Advising persons with disabilities of their rights and
responsibilities under the federal Rehabilitation Act and employment
section of the Americans with Disabilities Act.
Assisting individuals with disabilities resolve problems
or disagreements with rehabilitation service providers.
Helping clients with the appeals process if denied
rehabilitation services
Referring individuals who are ineligible for
rehabilitation services to other public or private agencies that may be
of assistance.
Should you currently have an existing
open case with Nevada’s Client Assistance Program via the Department of
Employment, Training, and Rehabilitation, Rehabilitation Division, you
may choose to have your open case transferred to NDALC for the
continuation of your case;
the Nevada Rehabilitation Division will ensure that your case file and
any relevant information associated with it will be confidentially
transferred to NDALC in a timely manner. Should you choose to close
your case with the Client Assistance Program, your case file will be
closed per your direction, and all relevant documentation will be stored
according to the State of Nevada’s file storage and retention schedule.
Regardless of your choice, if you have not already done so, please
notify the Rehabilitation Division at your earliest convenience of your
preference to transfer your open case to NDALC, or to close your open
case. You may do so by whichever means is most convenient to you - via
